Businessinschools.co.uk (the "Site") is a website promoting work related learning. The Site is operated by Edge Foundation, an educational charity (company number 0168164) ("we" or "us"). The following terms and conditions govern the use of the Site by schools, colleges, employers, intermediaries and others that have registered with the Site and any other users of the Site ("you"). By registering with or otherwise using the Site you agree to be bound by these terms and conditions. These terms and conditions may be amended from time to time. Notification of any changes will be made by posting new terms onto the Site. In continuing to use the Site you confirm that you accept the revised terms and conditions.

Registration

You agree that all information supplied on registration and your user profile will be complete and accurate and will be kept up to date at all times. We will use the information provided to us to contact you. You agree to keep your user log in and password confidential at all times and not permit them to be used by any third party for any reason whatsoever. You must notify us immediately if you become aware of any unauthorised use of your user account, log in or password. Multiple registrations are not permitted and we reserve the right at our discretion to delete or cancel the registration of any person who in our opinion is using the Site under more than one registration.

Changes to the Site

We may make changes to the format of the Site, services provided or to the Sites content at any time without notice.

Use and Abuse of the Site

You may not publish or upload (or permit to be published or uploaded using your account) any offensive, inaccurate, misleading, defamatory, fraudulent, immoral or illegal content. If any such content or content which in our opinion may damage our goodwill or the goodwill attaching to the Site is published or uploaded then we reserve the right at our discretion and without notice to remove it immediately and take such other action as we deem necessary in relation to that content and your ability to access the Site. You should carry out all investigations and searches that you would normally carry out before having any dealings with, or entering into any relationship with, any such person (including in respect of any content which they have published on the Site). We do not accept any responsibility whatsoever for the performance by any third party who you contact, or who contact you, through or using the Site of any obligations that they have assumed to you or their acts or omissions generally. Your rights and remedies against such person will be governed by the terms of your agreement with them.

Rating System

We may at our discretion operate a rating system under which users of the Site may comment on and rate the performance of other users. You agree that other users may publish comments and ratings about you on the Site which may be viewed by others. You also agree that we are not responsible for and shall have no liability in respect of any comment or rating posted by any user. It is intended that only positive comments and ratings be published on the Site and you agree not to publish any negative comments or ratings on the Site, that any comments or ratings will be given in good faith and will be accurate, not misleading and will otherwise comply with these terms and conditions. You will not post any comment or rating concerning yourself (or permit any person to do so on your behalf) which purports to come from a third party.

Intellectual Property

All copyright and other intellectual property rights in the Site (and associated database on which information obtained from the Site is stored) and the software, design, text, logos, graphics, registered and unregistered trademarks and other material on or used in conjunction with the Site and the selection and arrangement thereof is our property (or the property of persons who have licensed the same to us). Save as provided below, neither you nor anyone you are responsible for have, or will acquire, any interest in such intellectual property rights, whether under these terms and conditions or otherwise. We grant to you a non-exclusive, non transferable licence to use the Site solely for the purposes which we may permit from to time to time and strictly in accordance with these terms and conditions. Liability

We do not charge you for the provision of the Site and the services thereon. Accordingly: we exclude all warranties whatsoever to the fullest extent permitted by law in relation to the operation of the Site and your account. For the avoidance of doubt we provide no warranty that the Site or the use of your account will be uninterrupted or error free; we are unable to accept and hereby exclude any and all liability (whether arising in contract, tort or otherwise and whether or not due to our negligence) which we may otherwise have to you relating to or in connection with the Site or your use of it including without limit liability as a result of the unavailability of the Site or your user account, any technical, factual, textual or typographical inaccuracies, errors or omissions on or relating to the Site or any information on the Site, or any misrepresentation on or relating to the Site (other than a fraudulent misrepresentation made by us or on our behalf); and we shall in any event have no liability for indirect or consequential losses including without limit pure economic loss, loss of data, income or profits, loss of business, loss of operation time, loss of any equipment or process, loss of anticipated savings or depletion of goodwill in any case which arise out of or in connection with the Site. We will not be responsible for any breach of these terms and conditions caused by circumstances beyond our reasonable control. You agree that each of the limitations contained in these conditions is reasonable particularly having regard to the fact that we do not charge you for the provision of the Site. None of the exclusions or limitations in these conditions shall exclude or restrict our liability for death or personal injury caused by our negligence, seek to exclude liability for any fraudulent misrepresentation made by us or shall affect any statutory rights which are not capable of being excluded.

Indemnity

You agree to indemnify us against any and all costs, claims, liabilities, losses or expenses whatsoever that we may suffer or incur as a result of your use of the Site or any services or information accessible over or through the Site including information obtained from linked sites, your submission or transmission of information or material on or through the Site and any breach by you of these terms and conditions.

Cancellation and Termination

We reserve the right at our discretion to remove any content from the Site, restrict your access to the Site and/or terminate your user account at any time for any reason including, but not limited to, as a result of any breach of these terms and conditions. In the event that your user account is terminated we will delete your user profile, delete any of your content from the Site and you will no longer be entitled to access or use the Site or to re-register. Please note that content may continue to be accessible in search engine caches or on other sites and we cannot agree to delete such content.

Site Administrator

If you have concerns regarding any other user or content contained on the Site then please contact the site administrator at info@businessinschools.co.uk. Queries or complaints should also be sent to the site administrator at that address. We are not obliged to take any action in connection with any complaint regarding the Site or another user but if we do investigate the matter then we shall be entitled to deal with it in such manner as we see fit. We will not adjudicate disputes between users.

Data Protection

All notices will be sent to the email address provided with your registration details (as updated by you). By accepting these terms you give your consent to receive communications from us by email and you agree that all agreements, notices, disclosures and other communications that we provide to you by email satisfy any legal requirement that such communications be in writing. Any information and content posted onto the Site including sensitive and personal information is publicly available. Some or all of the information that you provide when registering with us (or when updating your profile) will be displayed on the Site together with content posted by you. You expressly consent to the public display of such information on the Site. Personal information that you supply to us will be used in connection with the operation of the Site and for purposes of sending you marketing messages relating to the Site and other web-sites operated by us. We may sub contract responsibility for the operation of the Site or any part of it to a third party. If you breach these terms and conditions and we decide to take no action or neglect to do so, then we will still be entitled to take action and enforce our rights and remedies for any other breach. These terms and conditions are governed by and construed in accordance with the laws of England and Wales. You agree, as we do, to submit to the non-exclusive jurisdiction of the English courts.
